Terms of Use 

The Learning Disabilities Association of Ontario operates an interactive website called “Access” (this Site) which includes:

  • Access Learning, which provides Registered Users with the ability to complete online courses and workshops related to education and learning on an ongoing basis

  • Access Community, which allows Registered Users to participate in public message boards

  • Access Resources, which allows Registered Users to browse information of interest

By registering for Access or by simply using or downloading information from this Site the User represents that they have read and understood the Learning Disabilities Association of Ontario's General Terms of Use and the Terms of Use specifically relating to this site, and agree to be bound by them. If the User does not agree with any part thereof, the User should not use this Site and if the User has been registered and given a User Identification and Password by the Learning Disabilities Association of Ontario (LDAO) to visit this Site, the User should inform LDAO of the decision and return the User Identification and Password to LDAO. By registering for any resource contained in the Access Site or by simply using or downloading information from this Site, the User agrees to utilize LDAO's services in a manner consistent with all applicable laws and regulations and in accordance with these terms of use.

User Permission:

Users are granted for a stated term, a personal, and non-transferable permission to visit and use this Site for personal, educational and non-commercial use only. Modifications of any materials on this Site or use of the materials for any purpose other than as contemplated in this Site is a violation of the Learning Disabilities Association of Ontario 's copyright and proprietary rights. The User agrees not to reverse engineer, duplicate, publish, modify, or otherwise distribute the materials on this Site unless specifically authorized in writing by the Learning Disabilities Association of Ontario to do so.

Registered Users agree to: (a) provide true, accurate, current and complete information about themselves as prompted by the Access registration process, and (b) to maintain and update such information to keep it true, accurate, current and complete. If any information provided by the User is untrue, inaccurate, not current or incomplete, this Site has the right to terminate the User's account and refuse any and all current or future use of this Service.

The Learning Disabilities Association of Ontario does not guarantee the accuracy or completeness of any information or content on this Site. The User agrees that they must evaluate, and bear all risks associated with, the use of any Service, including any reliance on the accuracy, completeness, or usefulness of any content on this Site.

Permissions:

Permission to some sections of this Site is restricted to those Users holding current, valid User Identifications and Passwords. LDAO Administration controls, manages and administers the grant of such User Identifications and Passwords. LDAO warrants that any such User Identifications and Passwords shall be kept in a safe and secure place and will be distributed only to Registered Users. The Learning Disabilities Association of Ontario may terminate access to any User at any time for any reason without notice. User Identifications and Passwords are confidential, personal and may not be shared or transferred by any User. It is important that the User exit under their User Identification and Password at the end of each session. Accordingly, a Registered User's ability to visit the Site (including the expiration date of the User Identification and Password) is strictly controlled by LDAO. Registered Users of Access Learning should refer to specific Workshop and/or Course information regarding the expiration or termination of User Identifications and Passwords.

Access Postings:

To the extent that certain areas of this Site (including, but not limited to, the Access Learning Site) provide Users an opportunity to post answers to on-line quizzes and converse asynchronously using course/workshop bulletin boards ("Postings"), please be advised that the Learning Disabilities Association of Ontario has no obligation to screen, edit, or review such postings for accuracy or otherwise prior to their appearance on this site. Such Postings do not necessarily reflect the views of the Learning Disabilities Association of Ontario.

This Site may establish an upper limit on the size of the data it will maintain for Postings for any one User. To the fullest extent permitted by applicable laws, the Learning Disabilities Association of Ontario shall in no event have any responsibility or liability for the Postings (or the loss thereof for any reason) or for any claims, damages, or losses resulting from their use (or loss) and/or appearance on this Site. The Learning Disabilities Association of Ontario reserves the right to monitor all Postings and to remove anything which it considers in its absolute discretion to be inaccurate, offensive or otherwise in breach of LDAO's General Terms of Use or for any other reason as it deems necessary. The Access User hereby represents and warrants:

  • That LDAO has all necessary rights in and to all Postings and all material they contain

  • That such Postings shall not infringe any proprietary or other rights of third parties

  • That such Postings shall not contain any viruses or other contaminating or destructive devices or features

  • That such Postings shall not contain any defamatory, indecent, offensive, tortuous, or otherwise unlawful material or content

  • That such Postings shall not be used to carry out or solicit any unlawful activity and/or be used to make commercial solicitations

By Posting on this Site, the User making such Posting hereby grants to the Learning Disabilities Association of Ontario and all other Users the non-exclusive, worldwide, perpetual and irrevocable right to use, copy, transmit and edit as desired any Posting, in any and all languages, formats and media, now known or hereafter developed.

Email Newsletters:

Please be advised that the Access email newsletter ("Newsletter") is part of a wide distribution, and that neither the Learning Disabilities Association of Ontario nor any third party involved is monitoring, reviewing or screening the recipient email list prior to its distribution. The Newsletter is distributed only to those who have expressly opted-in to receive them. If local, provincial or federal rules or regulations prohibit the recipient from receiving these types of Newsletters or the recipient simply does not wish to receive the Newsletter in the future or the Newsletter was sent to recipient in error, the recipient should immediately opt-out from receiving similar future offers and/or Newsletters by contacting the Learning Disabilities Association of Ontario and updating his or her subscription. The recipient can always opt back in to receive future offers and/or Newsletters at any time through the Access Site. To review and modify the categories of offers and/or Newsletters for opt-in, please go to the LDAO Access website and edit your User preferences.

Access Termination:

The Learning Disabilities Association of Ontario reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, this Site or the Services or any part thereof, with or without notice. The User agrees that the Learning Disabilities Association of Ontario will not be liable to the User or any third party for any modification, suspension, or discontinuation of this Site or Services or any part thereof. Further, the Learning Disabilities Association of Ontario reserves the right to terminate your User Identification and Password and the use of this Site or any of the Services for any reason, or if the Learning Disabilities Association of Ontario believes that the User has violated or acted inconsistently with this Terms of Use. The User agrees that any termination of access to this Site or any Services under any provision of this Terms of Use may be effected with or without prior notice, and acknowledge and agree that the Learning Disabilities Association of Ontario may immediately deactivate or delete a User Identification and Password and all related information and files under that User Identification and Password and/or bar any further access to this Site or any Services. Further, the User agrees that the Learning Disabilities Association of Ontario will not be liable to the User or any third party for any termination of access to this Site or any of the Services.

Access Security:

The User is responsible for maintaining the confidentiality of the User Identification and Password, and is fully responsible for all activities that occur under the User Identification and Password. A Registered User's identification and password should only be disclosed to the User and the User's parents/guardians, if applicable. The User agrees to (a) immediately notify this Site of any unauthorized use of the User Identification and Password, or any other breach of security, and (b) ensure that the User exits from use of this Site under the User Identification and Password at the end of each session. The Learning Disabilities Association of Ontario cannot and will not be liable for any loss or damage arising from the User's failure to comply with this General Terms of Use
